Reconsideration- If the taxpayer's case is no longer at the IRS Examination or Audit phase, and has reached the IRS collections phase, then the taxpayer's options for resolving the debt can be severely limited. There is, however, at least one option that remains available to the taxpayer, and that is to submit a request for reconsideration. The request must be made in writing and typically must be submitted to the IRS Reconsideration Department together with all documentation and other relevant materials that support or the taxpayer's request.
The typical case that is ripe for Reconsideration often occurs in situations where you've been hit with an audit and the IRS presents you with a report that reflects a higher tax liability than you believe is accurate. It's not necessarily over! While only 1 person in 10 actually requests audit reconsideration, the odds of having your audit reconsidered in your favor are actually decent. The IRS itself admits that on average, an approved reconsideration request can, in certain situations, cut out 40% of your taxes, interest and/or penalties.
You could, as part of your reconsideration request, make a request under the Freedom of Information Act (FOIA), which allows you to read the auditor's file, thereby giving you an idea of what factored into the generation of the report and determination of liability. It should pinpoint the specific items that resulted in the tax liability determination.
With the assistance of an experienced tax attorney, you can effectively request reconsideration of your situation and maximize the chances of obtaining relief through the reconsideration process.
While audits are frequently based upon numbers, rules and laws and/or hard facts, audit reconsideration involves more in the way of compromise, negotiation and strategy. A tax attorney can often help you maximize your chances of benefitting from the audit reconsideration process. Call Bell Law today to schedule an appointment to discuss your tax situation and determine whether representation might benefit you!
Obtaining relief through the Reconsideration Department is not a sure thing and is not usually easy to accomplish. There are instances in which a taxpayer seemingly deserving of reconsideration can have his, her or its request denied.
