Steps to create a valid contract in Illinois

Many years ago, it may have been possible for parties to honor the terms of a handshake contract. However, it is now assumed that a contract that is not in writing may not be enforceable. In many cases, a contract dispute that does not involve a written agreement may be particularly difficult to enforce.

By taking certain steps, parties to an agreement can put it in writing and avoid being stuck with a Jersey contract. The first step is to identify the intent and the terms of the contract. A good contract will have as many details as possible to reduce the risk of a dispute in the future. For instance, a deal to clean someone's house will typically include terms such as how often the house is to be cleaned and how much it will cost to provide the service.

Other terms may include when payment is to be made and any consequences for not making the payment on time. The parties to the agreement may then review the contract before putting it into writing and signing the deal. Once the deal is placed in writing and signed, it acts as a binding agreement that can be enforced by a judge.

An attorney may be able to establish that he or she was not responsible for a breach of contract or may be able to argue that other parties breached the contract.
